From July 1, 2021 can already be used the new connected device of danger signaling V-16. However, and according to the regulations that regulate its use, only the devices without geolocation manufactured before the entry into force of this regulation, which has been demanded by the manufacturers of these systems. And have won the battle in court.
That is to say that for the purposes, and currently, any of these V-16 devices can be used without geolocation regardless of its date of manufacture, as long as they comply with the homologation requirements of the DGT, in addition to those that have said technology.
Also, and until January 1, 2026 The usual signaling triangles may continue to be used, although the new provision prevents their use in certain cases, since it is no longer allowed to walk along the road or the shoulder to arrange them. For this reason, it is highly recommended to have the new light signal.
The Supreme Court agrees with the manufacturers
As stipulated in the Royal Decree 159/2021 of March 16 in its first transitory provision:
The luminous V-16 signals may continue to be used as a V-16 signal until January 1, 2026 manufactured prior to the approval of this royal decree and that, in any case, they comply with all the technical characteristics.
However, the V16 Group association, which integrates several manufacturers of these devices, appealed to the Supreme Court this demand and justice has ruled in their favor so that the newly manufactured ones could be marketed and used.
Thus, the Supreme Court has agreed a precautionary measure by which it allows the use of the luminous beacons without geopositioning, “which are still valid and regardless of when they have been manufactured“, as detailed by this association.
Ultimately, users will not only be able to use those purchased and manufactured before the regulations came into force, but also those marketed and assembled after that date.
And it is that today, as the V16 Group defends and as Traffic has recognized, the technology that will allow communication with the national access point of the DGT of the position of the V-16 luminous beacons not yet developed.
This means that, even if you have a device with geolocation, you will not be able to communicate with the DGT network because the data sending protocol does not yet exist. In short, it did not make sense to leave out V16 beacons without geolocation manufactured after the entry into force of the law, since this system cannot yet be used.
This association therefore argued that the prohibition of luminous V-16 beacons without geopositioning made no sense since limited “the alternatives to improve the safety of drivers on the road since there are devices that, although they do not have this connectivity, are approved by the DGT “.
Why it is advisable to use the V16 signal and how it should be
In short, and until 2026, Spanish drivers can use multiple systems to indicate a breakdown of your car or vehicle to other users, including those not connected:
- V16 without geolocation.
- V16 with geolocation.
- Emergency triangles.
- Virtual triangles.
However, in this new regulation some precepts of the General Traffic Regulation are modified in the case of how to act and signal a car breakdown or vehicle.
Specifically, it does so in point 3 of article 130, where in this review it is stipulated that, in the event of an accident or breakdown, and if the vehicle cannot resume driving:
The occupants must leave the vehicle, as long as there is a safe place outside the traffic platform and, in any case, they must exit the vehicle on the side opposite to the flow of traffic. without traveling or staying in the lanes and shoulders that make up said platform. If the driving conditions do not allow the occupants to leave the vehicle safely, they will remain in the passenger compartment with the seat belt fastened.
And this means that currently, in the event of a mishap that prevents the car from continuing to circulate, You cannot place the triangles if you have to walk along the hard shoulder or along one of the lanes. of the road. In conclusion: only if you leave the road, either on the sidewalk or off the road in the case of an interurban road, could this element be located.
For this reason, it is advisable to switch to using the V16 signal, either with or without geopositioning, as it can be placed without getting out of the car since it is located on the roof of the car from the seat.
Of course, regardless of whether they are equipped or with positioning technology, they must be approved according to the requirements stipulated:
- type of light: flashing yellow auto.
- Visibility: minimum visible from 1 kilometer away.
- Autonomous power: they must have a battery and their autonomy must guarantee their use in a minimum of 18 months.
- Subjection: it must have magnets or the like to adhere to the vehicle.
For their part, connected must meet these requirements and also that of esend vehicle location every 100 seconds stopped to cloud DGT 3.0. (remember, not yet activated).
Finally, you can also use the virtual triangles V-27, although since they depend on the same access point technology to communicate with the Traffic network, they do not operate at the moment.
Likewise, this system will only be shown to cars that are connected by telematic means, directly or through a service provider, with the National Access Point for Traffic and Mobility Information.
