In the dispute over compensation for the diesel scandal engine EA189 at the Federal Court of Justice (BGH), a defeat of Audi is emerging for the first time. The Karlsruhe judges want to confirm four rulings by the Munich Higher Regional Court, which Audi buyers had largely awarded the required money, as it became clear in the hearing on Thursday. The verdict was announced for 3 p.m.
The EA189 engine was developed by Volkswagen, but was also used in various models from the VW subsidiary Audi. In previous cases, the BGH had missed concrete evidence that someone at Audi knew about the illegal exhaust technology. The Munich Higher Regional Court, on the other hand, came to the conclusion that it was unthinkable that not at least one person responsible for Audi was aware of it. Other lower courts could then use the OLG reasoning as a blueprint in the future. However, comparatively few victims have sued Audi directly. Most have demanded compensation from VW, which is much easier to enforce in court. (dpa / swi)
