The DGT protects cyclists a little more with tougher fines for drivers who do not respect them

The regulations stipulate that cars must overtake a cyclist or the driver of a moped (including the electric scooters) maintaining a minimum lateral distance of 1.5 m, for which part of the adjoining lane may be occupied or opposite.

This does not vary with the entry into force of the changes, but a nuance is added that must be taken into account: on those roads that have more than one lane in each directionit must forced to change lanes completelywhich means maintaining an even greater safety distance to carry out said overtaking.

Therefore the Article 35.4 from traffic lawwhich is the one that includes how the overtaking maneuvers of automobiles over cycles and mopeds should be carried out, has been written as follows:

The driver of a vehicle who intends to overtake a cycle or moped, or a group of them, must do so occupying part or all of the adjoining or opposite lane, where appropriate, of the roadway and keeping a safety width of, at less, 1.5 meters, except when the road has more than one lane in each direction, in which case the complete change of lane will be mandatory.

For the rest, there are no changes in the event that the cyclists, or a group of them, circulate in the opposite direction, which will continue in the same terms:

It is forbidden to overtake endangering or hindering cyclists traveling in the opposite direction, even if these cyclists are riding on the shoulder.

In the Road Safety Law, collected in the Royal Decree 6/2015 of October 30failing to overtake correctly as required by this same regulation means committing a Serious offense according to Article 76.c:

Failure to comply with the provisions of this law in terms of preference of passage, overtakingchanges of direction or direction and reverse gear, direction of traffic, use of lanes and shoulders and, in general, any violation of special traffic regulations for reasons of safety or flow of traffic.

Therefore, not completely occupying the adjoining lane to overtake cyclists and users of mopeds or scooters when possible will mean 200 euros fineas reflected in the code of sanctions.

The same amount will be applied in case of not respecting the lateral distance of 1.5 m on one-lane roads in each direction, as has been the case up to now. The sanction for advancing endangering or hindering bicyclists traveling in the opposite direction.

Other changes affecting cyclists

The new regulations also include a nuance on how cyclists must circulate from now on. This is a modification that stems from a recommendation from the DGT: that bicycles circulate in the city down the center of the lane. Thus, Article 15 (on the direction of circulation) stipulates that:

As a general rule, and especially in curves and elevation changes with reduced visibility, the vehicle will circulate on all roads subject to this law to the right and as close as possible to the edge of the road, with the exceptions determined by regulationmaintaining in any case sufficient lateral separation to make the crossing safely.

The nuance “with the exceptions that are determined by regulation” seeks, among other things, to enable cyclists to circulate in the center of the lane on urban roads in an upcoming modification of the General Traffic Regulations.

This would mean greater safety for the cyclist group, since riding on the right side of the lane makes them more vulnerable, for example when entering the blind spot of a car or a larger vehicle.

Lastly, and in terms of bike lanes, stop or park in a bike lane In addition to being actions that are prohibited, now are considered serious offenses and therefore they will be sanctioned with a fine of 200 euros, as stated in article 76.d of the Law.
